Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://formsubmits.com website (the "Service") operated by FormSubmits ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

General Conditions

Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.

Technical support is only available via email.

You understand that FormSubmits uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.

You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, FormSubmits, or any other FormSubmits service.

We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any FormSubmits customer, employee, member, or officer will result in immediate account termination.

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You must not upload, post, host, or transmit unsolicited messages.

You must not transmit any worms or viruses or any code of a destructive nature.

If your bandwidth usage exceeds 500 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by FormSubmits) of other FormSubmits customers, we reserve the right to immediately disable your account or throttle your hosting until you can reduce your bandwidth consumption.

The failure of FormSubmits to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and FormSubmits and govern your use of the Service, superseding any prior agreements between you and FormSubmits (including, but not limited to, any prior versions of the Terms of Service).

Accounts

When you create an account with us you must provide a valid email address and any other information that is accurate, complete, and current at all times to complete the signup process. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You must be 13 years or older to use this Site and Service. You must be a human — accounts registered by "bots" are not permitted and in the case of determining these accounts will be deleted immediately.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. FormSubmits cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You are responsible for all Content posted and activity that occurs under your account. You cannot create and own more than one free account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You cannot use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Account Contested by 2 or More Parties

In the case of an account being contested by 2 or more parties, FormSubmits will determine whom to grant ownership of the account to in the following way:

Ownership of a Premium account: the ownership of a premium account will be granted to whichever party made the most recent payment in the account unless proven otherwise.

Ownership of a Free account: the ownership of a free account will be granted to whichever party originally signed up for the account unless proven otherwise.

Payment, Refunds, Upgrading and Downgrading Terms

We have the right to ask for fees for our services. You'll need to pay those fees (plus anything owed), as set out in the specific conditions for the service or plan you choose.

All paid plans must enter a valid credit card. Free accounts are not required to provide credit card details. An upgrade from the free plan to any paying plan will immediately bill you. The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.

For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle. Downgrading your Service may cause the loss of Content, features, or capacity of your Account. FormSubmits does not accept any liability for such loss.

Service and Price Modifications

We reserve the right, at our sole discretion, to change, modify or discontinue the Service permanently or temporarily with or without notifying you. FormSubmits can make changes on prices or services without being liable to you or any third party.

Cancellation or Termination

You may terminate this Agreement by requesting Your Account to be deactivated and deleted while logged into the Service. If you terminate your FormSubmits Account you will not be able to access the Service.

FormSubmits may also terminate Your right to use the Site and/or Services with or without cause at any time. FormSubmits shall notify You via email to Your registered email account if We terminate Your Account. Your obligation to pay accrued charges and fees accrued up to the date of termination shall survive any termination of this Agreement. Upon expiration of the Subscription Term, or termination, howsoever occasioned, Your Subscription Plan shall immediately terminate and consequently, You may make use of the free version of the Service.

Copyright and Intellectual Property Right

We do not claim any rights over the material and information you provide to FormSubmits. Your profile and materials will remain yours.

The look and feel of the Service is © 2025 FormSubmits. All rights reserved. The name and logos of FormSubmits are trademarks of FormSubmits. All rights reserved. These trademarks cannot be used without the permission of FormSubmits.

The Products and Services, including all content, included on our user interfaces, or delivered to members as part of the Products and Services, including, but not limited to, source code (HTML/CSS, Javascript), data compilations, software, visual design elements and concepts are the property of FormSubmits and protected by international copyright, trade secret or other intellectual property laws and treaties.

Third Party Links

Our Site and/or Services may include links to certain websites, materials, or content developed by Third Parties and not owned or controlled by FormSubmits. FormSubmits has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

You further acknowledge and agree that FormSubmits shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. Use of any such linked material shall be at Your own risk. FormSubmits reserves the right, in its sole and absolute discretion, to discontinue links to any other material at any time and for any reason. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Changes To This Terms Of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. Any new features that augment or enhance the Site, including the release of new tools and resources relating to the Service, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
